Welcome to Cafixi. By downloading, accessing, or using our mobile application or website (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the Service.

1. Description of Service

Cafixi provides AI-powered vehicle diagnostic information based on symptoms you describe and photos you submit. The Service is designed to help you understand potential issues with your vehicle, estimate possible repair costs, and locate nearby repair shops.

2. ⚠️ AI Diagnosis Disclaimer

Cafixi is NOT a substitute for professional mechanical advice or repair.

Our AI provides educational and triage information only. Diagnoses and cost estimates are approximate and may be inaccurate. Always consult a certified mechanic before performing any repairs, especially for safety-critical systems (brakes, steering, airbags, etc.).

You assume all risk for actions taken based on Cafixi's output. We are not responsible for any damage to your vehicle, injury, or financial loss resulting from reliance on the Service.

3. Eligibility

You must be at least 13 years of age to use Cafixi. By using the Service, you represent that you meet this requirement and that you have the legal capacity to enter into these Terms.

4. Account Registration

Some features require creating an account. You agree to provide accurate information and to keep your account credentials secure. You are responsible for all activity that occurs under your account.

5. Subscriptions & Billing

  • Free Plan: Includes one (1) fully-unlocked diagnosis (lifetime) and up to three (3) diagnoses per day with partial results.
  • Pro Plan ($3.99/month): Includes unlimited fully-unlocked diagnoses and all premium features.
  • Auto-renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
  • Billing: Payments are processed through Apple App Store. Refunds are subject to Apple's policies.
  • Cancellation: You may cancel anytime through your App Store subscription settings.
  • Price changes: We may modify subscription prices with at least 30 days' notice. Continued use after a price change constitutes acceptance.

6. Acceptable Use

You agree not to:

  • Use the Service for unlawful purposes.
  • Reverse engineer, decompile, or attempt to extract source code.
  • Use automated tools (bots, scrapers) to access the Service without permission.
  • Submit content that is harmful, infringing, or offensive.
  • Share your account credentials with others.
  • Attempt to circumvent usage limits on the Free Plan.

7. User Content

By submitting photos, vehicle information, or other content ("User Content"), you grant Cafixi a non-exclusive, royalty-free license to process and store that content solely for the purpose of providing the Service. You retain ownership of your User Content.

You represent that you have the right to submit any User Content you upload.

8. Intellectual Property

All Cafixi software, design, branding, and content (excluding User Content) are owned by Cafixi or its licensors and are protected by intellectual property laws. You may not copy, modify, or distribute our content without permission.

9. Third-Party Services

Cafixi integrates with third-party services including OpenAI, Google Places, and Firebase. We are not responsible for the availability, accuracy, or content of third-party services.

10. Disclaimer of Warranties

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that diagnostic results will be accurate.

11. Limitation of Liability

To the maximum extent permitted by law, Cafixi and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the Service.

Our total cumulative liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or USD $50, whichever is greater.

12. Indemnification

You agree to indemnify and hold harmless Cafixi from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without cause or notice. You may terminate your account at any time by deleting it from within the app or by contacting us.

14. Changes to These Terms

We may modify these Terms at any time. The "Last updated" date will reflect the most recent changes. Continued use of the Service after changes are posted constitutes acceptance.

15. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict of law principles. Any disputes shall be resolved in the state or federal courts located in California.
